I believe it`s legal, but the hardest part is figuring out where you can sell used mattresses, and that`s what I want to know. I was wondering if you could sell Homebrew DS games that you make. I plan and want to either publish it or sell it for money. Pepper spray is legal for shipping, selling, and shipping within New Jersey. It is NOT illegal to sell homebrew games that YOU have created. However, without the author`s permission, it is illegal to sell homebrew games that others have made. I think the answer would be yes and no. Yes, you CAN sell them. But no, you probably won`t get the chance. If I`m right, all commercial DS games have to go through Nintendo and so on, which makes the process of making a game available for legal sale very long and very difficult. But I believe ROMs can be sold, although I honestly don`t see who will buy a game`s ROM; You will then have to buy a card to put them on, and the software/hardware to do all the jazz which becomes quite expensive. But don`t quote me about it, I`m not 100% positive. I think it`s a legal thing because the homebrew developer has the right to all the materials used in his homebrew (if, of course, he made his own resources).
In addition, libnds was created from scratch. Unlike Xbox homebrewers, NDS homebrewers don`t use an illegal compiler. DevkitARM is completely legal. I saw that some GBA homebrews were sold some time ago. I will receive the link and edit my message as soon as I find it. EDIT: Eh. does not seem to find it in the GBAdev news archive. Well. Why not just make homebrew free? Are they? Don`t need a license to create video games for consoles? Or is it only for some consoles? Or do homebrew developers have these licenses? Any information anyone knows on this topic would be helpful.

LOL – Not really as technical as you`d like, but you shouldn`t let that technical jazz stop you from doing something awesome like a game and stuff.
